INFORMATION ON THE PROCESSING OF PERSONAL DATA (ART. 13-14 EU REG. 2016/679)

The company Enginko srl for the purposes provided for by the EU Regulation no. 2016/679 concerning the protection of individuals with regard to the processing of personal data, hereby informs that the processing of personal data provided and acquired will be processed in compliance with the provisions of the aforementioned Regulation in compliance with the consequent rights and obligations. B) Legal basis of the processing The Data Controller processes Personal Data relating to the User if one of the following conditions exists: • the User has given consent for one or more specific purposes; • the processing is necessary for the execution of a contract with the User and / or for the execution of pre-contractual measures; • the processing is necessary to fulfill a legal obligation to which the Data Controller is subject; • the processing is necessary for the performance of a task of public interest or for the exercise of public authority vested in the Owner; • the processing is necessary for the pursuit of the legitimate interest of the Data Controller or third parties. However, it is always possible to ask the Data Controller to clarify the concrete legal basis of each treatment and in particular to specify whether the treatment is based on the law, provided for by a contract or necessary to conclude a contract, or if based on consent. C) Purpose of the treatment The personal data processed (for example: addresses, telephone numbers and emails, photographs, etc.) are necessary for the following purposes related to the implementation of obligations relating to legal, contractual and pre-contractual obligations, as well as product promotion and services similar to those requested on the basis of the consent of the interested party; more precisely: • obligations required by law in the tax and accounting field; • after-sales assistance; • marketing activities relating to services similar to those already purchased and business promotion; • management of disputes; • customer management; • customer billing history. The processing of functional data for the fulfillment of these obligations is necessary for the proper management of the contractual relationship and their provision is mandatory to implement the purposes indicated above. The Data Controller also announces that any non-communication, or incorrect communication, of one of the mandatory information, may cause the Data Controller to be unable to guarantee the adequacy of the processing. D) Methods of treatment, communication and dissemination. Each treatment takes place in compliance with the procedures set out in Articles. 6, 32 of the GDPR and by adopting the appropriate security measures provided and in any case with organizational methods and with logic strictly related to the purposes indicated. Communication: your data will be communicated exclusively to competent and duly appointed subjects for the performance of the services necessary for proper management of the relationship, with a guarantee of protection of the rights of the interested party. Your data will be processed only by personnel expressly authorized by the Data Controller and, in particular, by the following categories of employees: Marketing department; Administration and accounting office; commercial office; Information activity relating to the products of the Data Controller necessary for the promotion of the same. Your data may be disclosed to third parties duly appointed as Data Processors whose list is available at the company, in particular to: • company of the group for the management of administrative and accounting relations; • commercial partners for promotional operations on products and services similar to those already purchased; • consultants (including IT) and freelancers, also in associated form; • banks and credit institutions; • in the context of public and / or private entities for which the disclosure of data is mandatory or necessary in compliance with legal obligations or is in any case functional to the administration of the relationship; • freight forwarders, transporters, owners, post offices, logistics companies. Any photographic material collected on the occasion of events, exhibitions, fairs, parties may be published on social networks. Dissemination: Your personal data will not be disclosed in any way. E) Data retention period The retention of personal data will take place for a period established for a period of time not exceeding the achievement of the purposes for which they are collected and processed for the execution and fulfillment of the contractual and pre-contractual purposes as well as in compliance with the mandatory time limits prescribed by law. (and therefore for a period not exceeding 10 years from the conclusion of the assignment-contractual relationship). When the processing is based on the User’s consent, the Data Controller may keep the Personal Data longer until such consent is revoked. Furthermore, the Data Controller may be obliged to keep Personal Data for a longer period in compliance with a legal obligation or by order of an authority. At the end of the retention period, the Personal Data will be deleted. Therefore, at the end of this term the right of access, cancellation, rectification and the right to data portability can no longer be exercised.
